2) Who we are.
This Website runs under 3 domain names www.bryantfoods.co.uk , www.thenuthouseplymouth.co.uk , www.bryantfoods.uk , it is owned by Matthew Bryant as a “sole trader” Trading under the name “The Nut House” at stall 93-94 pt86 Plymouth Market, Cornwall Street, Plymouth, PL11PS.
3) Ordering.
- You may place any orders through our website using order forms at the checkout process.
- All Orders will be confirmed by email to the address given by the buyer.
- All Products are subject to availability so if an item is out of stock and unlikely to be delivered within 2-5 working days, we will contact you on the matter.
- A buyer can only register their details once. Any information or login details forgotten can be recovered by using the Lost Password link in the account details section.
4) Cost and Payment
- The price of the products shown on our website will include VAT where appropriate. The Prices can be reviewed or altered at our discretion when required dependent on any fluctuating costs which may occur.
- Payment can be made online by credit/debit card or PayPal and must be paid in full before products can be delivered to the buyer.
- Refunds will generally be made by means of credit to your original payment choice.
- If in the event of a refused card payment The Nut House/Bryant Foods will not be liable for non-delivery or delays in the dispatch of products. The Nut House/Bryant Foods retain ownership and title of any products until full payment has been received. In the event of customer refund, ownership and title will revert to The Nut House/Bryant Foods.
- Card details entered through our checkout section are securely used via the PayPal payment gateway.
- The Buyer is responsible for keeping their details secure by confirming to log out at the end of each session and not to share their details with 3rd parties.
- If an order has been placed and paid for without the knowledge or authorisation of the Card holder themselves The Nut House/Bryant Foods cannot be held responsible. In this situation we can only refund the customer only if the order has not been dispatched within the one working day.
5) Delivery Charges
- Where applicable, there will be a delivery charge displayed in the buyers shopping cart prior to confirming an order. Please see dispatch and delivery section to see the different prices and options.
- The cost of delivery will depend on as follows:
- The weight of your Order.
- The size of your order.
- Where the order is to be delivered (Within the coverage of the UK postal codes delivery companies are able to cover, there may be some exception for the Isle of Wight, and the Isles of Scilly.)
- The Buyers order will be dispatched once payment has been received and will be then delivered within 2-5 working days dependent on the size of your order.
- If there is a mistake or incorrect delivery address given after ordering, you must tell us as soon as possible. Please note The Nut House/Bryant Foods is not liable for any lost or damaged products if we are not notified before the products have been sent for delivery. You may also need to pay a further delivery charge if we are required to re-send your order to the new correct delivery address that has been given. This will be decided by the owner upon facing such situations.
- In the situation of products being delivered with proof of delivery provided, The Nut House/Bryant Foods cannot be made liable if the customer claims to have not received their order.
6) Website Information.
- Although we take care in the quality of content displayed on this website, sometimes errors may occur such as incorrect prices being shown or not updated. If a product is therefore ordered under these circumstances the buyer will be informed by The Nut House/Bryant Foods to offer a cancellation of the product/order or an updated order with the correct prices. We are under no obligation to sell The Nut House/Bryant Foods Products at the wrong price.
- All photos used on this website are owned by The Nut House/Bryant Foods and cannot be used or distributed without our written permission. The photos are to show the product only and sometimes the product could be different than what the image represents.
- All of our Products have been produced & packed in factories/The Nut House, in environments which handle Tree Nuts, Peanuts, Sesame Seeds, Seeds, Gluten, Soya, Milk/Whey, Mustard and Sulphur Dioxide/Sulphites etc.
So we cannot guarantee that cross contamination has not occurred with other ingredients. - The Nut House/Bryant Foods may change these Terms & Conditions from time to time and without prior notice to you, by updating this page. You should check this page from time to time to ensure that you are happy with any changes.
These Terms & Conditions are effective from September 2020.
7) Returns & Refunds
- Once an order has been made the buyer will have 14 days to cancel or alter their order.
The buyer must do this by emailing enquiries@bryantfoods.co.uk or phoning us on 07856771241 (9:30 – 16:00 Monday to Saturday) and stating your order number and reason for cancellation. - Any damaged or incorrect goods received must be notified to us within 48 hrs of receiving the delivery.
- Where a customer makes a claim for a damaged/incorrect product, the goods must be returned to The Nut House/Bryant Foods within 14 working days in the same state in which it was received. Items must be securely packaged. If products returned are found damaged due to buyers handling, the buyer will be liable for damaged goods.
- Upon receiving products back, The Nut House/Bryant Foods will inspect the goods and if they are in fact damaged/defected The Nut House/Bryant Foods will offer a Replacement or a full refund to the same account details given by the buyer when the order was made within 7 working days. The refund will include delivery costs (up to £12) including costs of damaged/ defected goods.
- If the Product is opened and used the order cannot be returned, refunded or cancelled.
- The buyer is fully responsible for arranging the return of any products to The Nut House.
- You are entitled to a 14 days refund from the day you received the products if: The Products are expired. The Packaging is damaged or not sealed. We misplaced your order and the products never arrived. Or you received the wrong products.
*Proof with pictures is required* - We do our best to make sure that all products that leave The Nut House/Bryant Foods are in perfect condition, it is your responsibility to ensure that all the goods received are in perfect order (eg. expired, missing, damaged, stale). If you start using the products with any of the mentioned issues, we are not responsible for the damage these issues may cause.
** We’ll not refund or accept returns of any products that are opened or damaged by you, the customer.
8) Legal disclaimer
Whilst we work hard to ensure that product information provided to all our customers is correct, the information is provided to us by our suppliers/their Manufacturers, so we are not responsible if the information provided to us by these 3rd parties is incorrect.
9) Computer Offences
If you do anything which is a criminal offence under a law called “The Computer Misuse act 1990”, your right to use this site will be terminated immediately and we will report you to the relevant authorities and give them your identity.
Computer misuse includes introducing viruses, trojans, worms, and other harmful, technical or damaging material.
You must not try to gain access to this website or server or any connected database or make any “Attack” on the site.
We won’t be legally responsible to you for any damage from viruses or other harmful material that you pick up via our website.
